Liability Waiver

Onslow Priority is a community reporting and coordination tool. It is not a replacement for 911 or professional emergency services.

Assumption of Risk

By using this app, you acknowledge that emergency response depends on availability of responders, network connectivity, and other factors outside the platform's control. The platform cannot guarantee response times or outcomes.

Limitation of Liability

Onslow Priority, its operators, and developers are not liable for damages resulting from use or inability to use the platform, including delays in emergency response, inaccurate location data, or communication failures.

Emergency Guidance & Instructions

The app may display non-blocking situational guidance (for example, "Begin CPR," "Seek shelter," "Evacuate immediately") and estimated priority ratings when you select an emergency type. This guidance is general information provided for reference while you wait for professional help. It is not medical advice, is not tailored to your specific situation, and may be incomplete or inaccurate for your circumstances. Priority ratings are estimates based on the information you provide and may change as responders assess the situation. Always call 911 for life-threatening emergencies, and follow the instructions of 911 operators and professional responders over any guidance shown in this app.

Good Samaritan & Responder Liability

Onslow Priority supports voluntary, responsible emergency assistance within a responder's training, authorization, and applicable law. Good Samaritan protection comes from applicable law — not from this platform. North Carolina provides liability protections for qualifying individuals who voluntarily provide qualifying emergency aid, subject to statutory requirements and exceptions. The platform does not claim to create immunity. It does not ask community responders to exceed their training, act as licensed professionals when they are not, ignore dangerous conditions, enter unsafe scenes, or perform procedures outside their authorization. Responder capabilities are tied to verified qualifications and community-defined requirements.

No Guaranteed Response or Outcome

The platform never represents an alert as a guaranteed response, and does not promise a medical, police, fire, rescue, or other emergency outcome. It distinguishes between Alerted, Acknowledged, Responding, and Arrived, and between reported and confirmed information. Response times and outcomes depend on responder availability, network connectivity, and other factors outside the platform's control.

User Responsibility

Users are responsible for providing accurate information, for following the instructions of 911 operators and professional responders, and for calling 911 directly in life-threatening emergencies. Users must not rely solely on in-app guidance in place of professional emergency services.

Indemnification

Users agree to indemnify the platform against claims arising from their use of the service, including any reliance on in-app guidance or priority ratings.

Availability and Connectivity

Delivery depends on networks, devices, notification permissions, battery, location accuracy and third-party providers. The platform does not warrant that a report, alert, notification, message or radio channel will be delivered, seen, or acted upon, or that any feature will be available at the moment it is needed.

Third-Party Information

Weather warnings, radar, mapping, traffic and public-feed information shown in the app comes from other providers and is reproduced as received. It may be delayed, incomplete or wrong, and it is not a substitute for an official warning, order or instruction.

Governing Law and Venue

This waiver is governed by the laws of the State of North Carolina, and disputes are brought in the state or federal courts sitting in Onslow County, North Carolina, to the extent the law allows. Nothing in this waiver excludes or limits any liability or right that applicable law does not permit to be excluded or limited.

Changes and Revisions

This waiver is dated and is revised in the application when it changes; continuing to use the service after a revision takes effect is acceptance of it. If any provision is found unenforceable, it is limited only as far as necessary and the remaining provisions continue to apply.
