User Agreement

Onslow Priority User Agreement, Terms of Service, Privacy Policy, and Liability Waiver

Effective Date: August 27, 2026

⚠ IMPORTANT EMERGENCY NOTICE — PLEASE READ

Onslow Priority is NOT a replacement for 911 or official emergency services.

If you are experiencing an immediate or life-threatening emergency, or otherwise require police, fire, EMS, rescue, or other official emergency assistance, call 911 or the appropriate local emergency number as soon as it is safe and possible to do so.

Onslow Priority is a technology platform designed to supplement emergency communication, community awareness, incident reporting, responder notification, welfare monitoring, and community assistance.

Use of Onslow Priority does not guarantee that: 911 will be contacted; an agency will be notified; an alert will be delivered; your exact location will be identified; a responder will receive or accept an alert; any person will respond; assistance will arrive within any specific time (including 1–3 minutes); information will be complete or accurate; or an emergency will be resolved successfully.

Do not delay contacting official emergency services while waiting for assistance through Onslow Priority.

PART I — ACCEPTANCE AND GENERAL TERMS

1. Acceptance of Agreement

This User Agreement, Terms of Service, Privacy Policy, Liability Waiver and Assumption of Risk, and Optional Information-Sharing Consent, together with any additional policies or agreements expressly incorporated into them, are collectively referred to as this "Agreement." This Agreement is between you ("User," "you," or "your") and Onslow Priority, including its owners, operators, authorized administrators, employees, contractors, representatives, affiliates, successors, and permitted assigns ("Onslow Priority," "we," "us," or "our"). By creating an account, clicking "I Agree," "Accept," "Create Account," or a similar acceptance mechanism, or otherwise accessing or using the Onslow Priority application, website, software, alerting systems, communications systems, welfare systems, community features, or related services (collectively, the "Services"), you agree to this Agreement. If you do not agree to the required portions of this Agreement, do not create an account or use the Services. Part VI states who your information is shared with, which forms part of accepting this Agreement.

2. Purpose of Onslow Priority

Onslow Priority is a technology and communications platform intended to support community safety, emergency reporting, emergency communications, community assistance, responder awareness, welfare monitoring, incident coordination, and other safety-related functions. Depending on your account, location, permissions, participating communities, participating organizations, available technology, and enabled features, the Services may include: CPR emergency alerts; AED response alerts; community responder notification; bleeding-control assistance alerts; trauma-care alerts; overdose emergency alerts; naloxone-related emergency response alerts where applicable and lawful; fire extinguisher response alerts; water rescue response alerts; search and rescue assistance; community assistance; automated welfare-check features; safety and welfare concern reporting; silent distress features; emergency location sharing; proximity-based emergency alerting; nationwide or multi-community responder alerting; system-wide emergency alerts; BOLO and public-safety awareness alerts; missing or endangered-person alerts; shelter-in-place and other protective-action alerts; SOS beacon features; audible alarms; screen flashing; flashlight activation; semi-automatic incident information gathering and triage support; quick-priority coding; incident coordination or routing features; community communications; restricted or gateway-controlled features; and other features made available through the Services. Features may change and are not necessarily available to every User or in every location. Connecting the Services to an organization's own computer-aided dispatch (CAD), mobile data terminal (MDT), radio or paging system is entirely optional: the Services operate fully without any such connection, on the information Users and communities enter themselves. Where an organization chooses to connect one of its systems, the connection is read-only unless that organization separately and expressly permits otherwise, every part of the exchange is switched on by that organization itself, and switching it off stops the exchange immediately. No User is entitled to a connection to any agency system, and no connection guarantees that an agency will receive, read, or act on anything.

3. Onslow Priority Is Not a Substitute for Official Emergency Services

Unless expressly stated otherwise in a separate written agreement with an authorized organization, Onslow Priority is not: 911; a Public Safety Answering Point; a police department; a fire department; an EMS agency; a hospital; a physician or medical provider; a guaranteed emergency dispatch service; or a guaranteed rescue service. Onslow Priority does not guarantee that an emergency report submitted through the platform will be transmitted to, received by, or acted upon by an official emergency agency.

4. No Guaranteed Response or Response Time

Certain features are intended to rapidly notify eligible nearby responders or participants. However, no statement, estimate, goal, advertisement, feature description, or expectation concerning rapid response—including a potential response within 1–3 minutes—constitutes a guarantee, promise, warranty, or contractual obligation. Actual response may be affected by: internet or cellular availability; device settings; notification permissions; GPS accuracy; battery level; user availability; distance; traffic; weather; scene safety; incorrect reports; delayed or failed notifications; whether a responder accepts an alert; and other technical or real-world circumstances. No User is guaranteed assistance within any specific time.

PART II — USER RULES AND RESPONSIBILITIES

5. Accurate Information and Responsible Use

You agree to provide information that is accurate to the best of your knowledge. You must not knowingly: submit a false emergency report; activate an emergency feature as a prank; intentionally provide a false location; provide knowingly false incident information; create a false BOLO; falsely identify someone as wanted, missing, endangered, dangerous, or in distress; misuse an SOS or silent distress feature; harass, threaten, stalk, or intimidate another User; impersonate another person or organization; misrepresent your training, certification, license, qualifications, or authority; attempt to bypass gateway-locked or restricted access; access information without authorization; interfere with an emergency response; or use the Services for unlawful activity. False or malicious reports may result in account suspension or termination and other action permitted or required by applicable law.

6. Responder Participation

Certain Users may have access to responder features. Receiving an alert does not create an obligation to respond. You are responsible for determining whether you are available, physically capable, properly trained, authorized, equipped, acting within applicable laws, certifications, licenses, organizational policies, and your lawful scope of practice, and able to respond safely. Unless specifically verified through a designated Onslow Priority verification process, access to responder features does not mean another User's qualifications have been independently verified. You must not provide assistance beyond your training, qualifications, legal authority, or applicable scope of practice.

7. Responder and Scene Safety

Emergency situations may be dangerous and unpredictable. You are responsible for using your own judgment and deciding whether it is reasonably safe and appropriate to respond. Do not knowingly place yourself or others at unreasonable risk. Onslow Priority does not require you to enter a dangerous scene. You may decline, cancel, or stop participating when you reasonably believe doing so is necessary for safety or compliance with applicable law.

8. Medical, Rescue, and Emergency Assistance

Onslow Priority does not guarantee that any User is qualified to provide CPR, use an AED, control bleeding, provide trauma assistance, administer emergency aid, participate in a rescue, or perform any other emergency function. Users who voluntarily provide assistance are responsible for acting within applicable law and their own qualifications. Nothing in the Services creates a doctor-patient, nurse-patient, EMT-patient, paramedic-patient, therapist-patient, or other professional relationship between Onslow Priority and a User.

9. Community Assistance

Community assistance features may connect Users seeking help with participating individuals or resources. Onslow Priority does not guarantee the availability, qualifications, conduct, safety, legality, or reliability of any independent User. Users should exercise reasonable judgment when interacting with other participants.

PART III — EMERGENCY, WELFARE, AND ALERT FEATURES

10. Silent Distress Features

Onslow Priority may offer a silent or discreet distress feature. Activation does not guarantee that 911 will be contacted, police will be dispatched, an official agency will receive the alert, a responder will receive or respond, location information will be accurate, or that assistance will arrive.

11. SOS Beacon

An SOS beacon may use available location information and may activate supported features such as an audible alarm, screen flashing, or flashlight activation. Functionality may be affected by hardware, permissions, battery, OS restrictions, connectivity, and other limitations.

12. Automated Welfare Checks

The Services may provide automated check-ins, reminders, missed-check-in notifications, welfare-related alerts, or related features. A missed check-in or automated alert does not guarantee that Onslow Priority will investigate, a responder will be sent, police or another agency will conduct a welfare check, another User will contact you, or that assistance will arrive.

13. Safety and Welfare Concern Reports

Users may report concerns regarding another person's safety or welfare. A report is not automatically a verified fact, medical or mental-health diagnosis, a determination that a person is dangerous, a legal finding, or a criminal accusation. Users must not knowingly submit false or malicious reports. Onslow Priority does not diagnose mental-health conditions or make clinical determinations through User reports.

14. Public-Safety Alerts and BOLOs

Certain alert types may be restricted to authorized Users or organizations. You may not create an alert that falsely appears to be an official BOLO, law-enforcement notice, missing-person notice, endangered-person notice, shelter-in-place order, evacuation order, emergency directive, or public-safety warning. During an active emergency, Users should follow lawful instructions from appropriate official authorities.

15. Proximity and Traveling Responder Alerts

Eligible Users may receive alerts based partly on their approximate or precise location. Where available, eligible responders traveling outside their usual community may receive alerts concerning nearby incidents in participating communities. This feature depends on location permissions, connectivity, platform settings, availability, and other factors and is not guaranteed.

16. Semi-Automatic Triage and Priority Coding

The Services may ask questions, organize reported information, assist with incident categorization, suggest classifications, or support priority coding. Any automated or semi-automated output is not a medical diagnosis, is not guaranteed to be correct, does not replace professional medical judgment or official emergency dispatch judgment, does not guarantee an emergency response priority, and may be affected by incomplete, inaccurate, or delayed information.

PART IV — PRIVACY POLICY

17. Information We May Collect

Depending on how you use the Services, we may collect or process: account information (name, username, email, phone, profile, role, community/organization affiliation); emergency and incident information (category, details, notes, date/time, response info, voluntarily submitted injury/symptom/health info); location information (approximate location, GPS coordinates, address, cross streets, ZIP, state, incident location); communications and submitted content (text, messages, photos, videos, audio, updates); and technical information (device, OS, app version, logs, diagnostics, security info, timestamps, crash reports).

18. How We Use Information

We may use information to create and manage accounts; provide requested Services; process emergency and welfare reports; deliver alerts and notifications; facilitate authorized responder communications; determine relevant proximity; operate SOS and location features; maintain safety and security; investigate misuse; troubleshoot and improve the Services; comply with applicable law; maintain necessary records; and protect Users and others.

19. How Information May Be Shared

Information may be shared with authorized recipients when reasonably necessary to operate a requested feature and subject to your applicable settings, permissions, and applicable law. Recipients may include authorized responders, volunteers, administrators, organizations, coordination personnel, emergency or public-safety personnel when appropriate and legally permitted, service providers, and government authorities where disclosure is legally required or permitted. Your information is made available to the professional responders, administrators and dispatchers who answer and run emergencies, as described in Part VI.

Onslow Priority will never sell, rent, trade, or otherwise share your personal information with third parties for their own marketing, advertising, or commercial purposes. Personal information is made available only to the emergency services and official emergency agencies that serve you, to the recipients you or your settings authorize for a feature you use, to service providers acting on our behalf under confidentiality obligations, and where the law requires disclosure.

20. Health-Related Information and HIPAA

The Services may process health-related information voluntarily submitted in connection with an emergency, welfare concern, incident, or other supported feature. Not all health-related information is automatically protected by HIPAA. HIPAA applies to particular entities and relationships under specific legal circumstances. Your information is handled as described in Part VI and this Part, and that handling does not by itself determine whether HIPAA applies. Where Onslow Priority becomes subject to HIPAA or another applicable health-information law, applicable law and any required agreements will govern those activities.

21. Data Security

Onslow Priority uses reasonable administrative, technical, and organizational measures intended to protect information. However, no electronic, internet-based, mobile, or cloud-based system can guarantee absolute security.

22. Data Retention

We may retain information for as long as reasonably necessary for legitimate purposes, including operating the Services, maintaining records, security, investigating misuse, resolving disputes, complying with legal obligations, and enforcing this Agreement. Retention periods may vary.

23. Children and Minor Users

The Services are not intended to collect personal information from children under 13 unless the legally required process is implemented. Where parental consent is required, applicable children's privacy requirements, including verifiable parental consent, must be followed.

PART V — LIABILITY WAIVER AND ASSUMPTION OF RISK

24. Assumption of Risk

By voluntarily using emergency-response or community-response features, or voluntarily responding to an incident, you understand that emergency situations can involve significant and unpredictable risks. To the maximum extent permitted by applicable law, you voluntarily assume the ordinary and inherent risks associated with your own voluntary participation and decisions. You understand that you are not required by this Agreement to accept an alert or participate in an incident.

25. Release and Limitation

To the maximum extent permitted by applicable law, you agree that Onslow Priority and its owners, operators, employees, contractors, administrators, affiliates, and authorized representatives shall not be responsible for losses arising solely from the ordinary and inherent risks of your voluntary use of the Services or your own voluntary decision to participate. Nothing in this Agreement is intended to release, waive, exclude, or limit liability where applicable law prohibits such a waiver or limitation.

26. No Guarantee Regarding Other Users

Onslow Priority does not guarantee the conduct, qualifications, intentions, actions, omissions, availability, or reliability of independent Users. Unless separately established in writing, participating Users act independently and are not automatically employees or agents of Onslow Priority.

27. Limitation of Liability

To the maximum extent permitted by applicable law, Onslow Priority shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of, inability to use, or reliance upon the Services. This may include losses associated with delayed or failed notifications, incorrect or incomplete information, incorrect location, technical failures, failure of another User to respond, independent acts or omissions of another User, and decisions voluntarily made by Users during an incident. Nothing in this section limits liability that cannot legally be limited.

PART VI — INFORMATION SHARING

28. Who Your Information Is Shared With

By accepting this Agreement you agree that your information may be made available to the people who answer and run emergencies: professional responders, administrators and dispatchers. Where relevant and available, that may include your name, contact and callback details, profile information, home and alert locations, GPS coordinates, incident address and cross streets, emergency details, voluntarily provided injury or health information, medication information, welfare-check information, photos, videos, audio, messages and other information reasonably relevant to a call. Receiving information does not guarantee that any person will review, act upon or respond to it.

29. Who It Is Not Shared With

Your information is not made available to other community members, is not published on any public page, and is not sold, rented, traded or used for advertising or any other commercial purpose. It is not disclosed to any party for that party's own purposes.

30. Health Information and HIPAA

Health-related information you choose to provide is handled as described in this Agreement. Not all health-related information is automatically protected by HIPAA, which applies to particular entities and relationships in specific legal circumstances. Where Onslow Priority becomes subject to HIPAA or another applicable health-information law, that law and any required agreements govern those activities.

31. Disclosure Required by Law

Onslow Priority may process, retain, use or disclose information where reasonably necessary and permitted or required by applicable law — including to operate the Services, process reports, provide requested features, maintain security, investigate misuse, protect life or safety, respond to valid legal process and comply with legal obligations.

32. No Separate Sharing Option

There is no separate information-sharing preference to accept or decline. Information needed to answer a call goes to the professional responders, administrators and dispatchers who handle it, and this forms part of using the Services. You remain in control of what you enter: optional details may be left blank, added later, or removed from your profile at any time.

PART VII — GENERAL LEGAL TERMS

33. Account Suspension or Termination

Onslow Priority may suspend, restrict, or terminate access when reasonably necessary for violation of this Agreement, false reporting, misrepresentation, harassment or abuse, safety or security concerns, fraud, or legal compliance.

34. Changes to the Services or Agreement

We may modify the Services or this Agreement. Where required by applicable law, we will provide appropriate notice and obtain any required consent before material changes take effect.

35. Severability

If a provision is determined to be invalid or unenforceable, that provision shall be limited or removed only to the extent legally necessary, and the remaining provisions shall continue to the maximum extent permitted by law.

36. Governing Law and Venue

This Agreement is governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Subject to any provision of law that applies to you and cannot be waived, the state and federal courts sitting in Onslow County, North Carolina have exclusive jurisdiction over any dispute arising out of or relating to this Agreement or the Services, and you consent to venue there. Where a community or organization deploys the Services outside North Carolina, that deployment may publish its own governing-law provision, which governs that deployment. Nothing in this section waives any consumer right that applicable law does not permit to be waived.

PART VIII — INTELLECTUAL PROPERTY AND ACCEPTABLE USE

37. Ownership of Onslow Priority

The Onslow Priority application, including all source code, software, designs, graphics, user interfaces, icons, text, alerts, workflows, audio, video, branding, logos, feature logic, databases, and any related materials, are the proprietary property of Onslow Priority and its owner and are protected by applicable intellectual-property laws, including copyright, trade-secret, and other applicable laws. All rights, title, and interest in and to the Services remain with Onslow Priority. Nothing in this Agreement transfers any ownership of intellectual property to you.

38. No Copying, Reverse Engineering, or Modification

You agree that you will not, and will not permit, enable, or assist any other person to: copy, reproduce, republish, download, scrape, store, redistribute, transmit, broadcast, sell, sublicense, lease, rent, or resell the Services or any part of the source code, design, content, data, or materials; reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to derive, reconstruct, or discover the source code, underlying ideas, algorithms, logic, file formats, data structures, databases, or non-public APIs of the Services; modify, adapt, translate, or create derivative works based on the Services or any part of them; remove, alter, or obscure any copyright, trademark, watermark, or other proprietary notices; use any automated script, bot, crawler, scraper, spider, extractor, or similar tool to access, collect, or extract data, content, or code from the Services; mirror, frame, or re-host the Services or any part of them; or circumvent, disable, or tamper with any technical protection, access control, security measure, rate limit, or license restriction. Unauthorized copying, reverse engineering, or reuse of the Services, source code, design, or materials is strictly prohibited, may result in immediate account suspension or termination, and may subject you to civil and criminal liability under applicable law.

39. Limited License to Use

Onslow Priority grants you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended personal and community-safety purpose, subject to your ongoing compliance with this Agreement. This license does not grant you any right, title, or interest in the source code, design, or underlying materials, except to use the Services as presented to you through the official Onslow Priority app or website. Onslow Priority may revoke this license at any time for any violation of this Agreement.

40. Feedback and Contributions

If you submit feedback, suggestions, ideas, or proposed improvements regarding the Services, you agree that Onslow Priority may use them without restriction or obligation to you, and that such submissions do not create any confidentiality or compensation obligation.

Final User Acknowledgment

By creating an account or clicking the applicable acceptance mechanism, you acknowledge that: (1) you have had the opportunity to read this Agreement; (2) you agree to the required User Agreement and Terms of Service; (3) you understand Onslow Priority is not a replacement for 911; (4) an alert does not guarantee a response; (5) no response time is guaranteed; (6) rapid-response goals are not guarantees; (7) you agree not to knowingly submit false reports or misuse emergency features; (8) you acknowledge the Privacy Policy; (9) location, emergency, communication, and other information may be processed as described; (10) automated triage is not a medical diagnosis or guaranteed dispatch determination; (11) you agree to the Liability Waiver and Assumption of Risk to the maximum extent permitted by law; (12) your information is shared with professional responders, administrators and dispatchers as described in Part VI, and is not shared with other community members, published, sold, or used for advertising; (13) you agree that the Onslow Priority source code, design, and materials are proprietary and you will not copy, redistribute, reverse engineer, decompile, disassemble, modify, scrape, or create derivative works from them; and (14) you agree to the Intellectual Property and Acceptable Use terms in Part VIII.

Source code, design, content, and all materials of Onslow Priority are proprietary. Unauthorized copying, redistribution, reverse engineering, or reuse of the source code, design, or materials is prohibited and may be subject to legal action.
